Article 442: 1. Debts becoming due

Part Two: Special Obligational Relationships › Chapter Six: Contracts of Service › Division One: General Contract of Service

Upon the termination of the contract, all debts arising from the contract shall become due.

The time at which they become due may be deferred by written agreement for up to six months in legal relationships established through the employee's intermediation where the debt assumed by the third party is to be performed wholly or partly after the termination of the contract of service; for up to one year in relationships involving periodic performances; and for up to two years in insurance contracts or in matters whose performance extends over a period longer than six months.

Where a share of the output is provided for, the share shall become due as soon as it is determined; where a share of turnover or profit has been agreed, the share shall become due at the latest at the end of three months following the accounting period.

MADDE 442 · 1. Borçların muaccel olması

Sözleşmenin sona ermesiyle, sözleşmeden doğan bütün borçlar muaccel olur.

Muacceliyet anı, işçinin aracılığı suretiyle kurulan hukuki ilişkilerde üçüncü kişinin üstlendiği borç, hizmet sözleşmesinin sona ermesinden sonra tamamen veya kısmen ifa edilecekse altı aya; dönemsel edimler içeren ilişkilerde bir yıla; sigorta sözleşmelerinde veya ifası altı aydan uzun bir süreye yayılmış olan işlerde ise iki yıla kadar, yazılı bir anlaşmayla ertelenebilir.

Üretilenden pay verilmesi öngörülen hâllerde ürün payı belirlenir belirlenmez, cirodan veya kârdan pay verilmesi kararlaştırılan hâllerde ise pay, hesap dönemini izleyen en geç üç ay sonunda muaccel olur.
