Article 81: Legal services and counselling

Part Three: International Protection › Chapter Two: General Procedures

(1) Applicants and persons holding international protection status may be represented by a lawyer in respect of the matters and procedures set out in this Part, provided that the fees are covered by themselves.

(2) An applicant or a person holding international protection status who is unable to afford lawyer's fees shall be provided with legal services, in his or her applications before the courts relating to matters and procedures within the scope of this Part, in accordance with the legal aid provisions of Law No. 1136.

(3) Applicants and persons holding international protection status may benefit from counselling services provided by non-governmental organisations.

MADDE 81 · Avukatlık hizmetleri ve danışmanlık

(1) Başvuru sahibi ile uluslararası koruma statüsü sahibi kişiler, bu Kısımda yazılı iş ve işlemlerle ilgili olarak, ücretleri kendilerince karşılanması kaydıyla avukat tarafından temsil edilebilir.

(2) Avukatlık ücretlerini karşılama imkânı bulunmayan başvuru sahibi ve uluslararası koruma statüsü sahibi kişiye, bu Kısım kapsamındaki iş ve işlemlerle ilgili olarak yargı önündeki başvurularında 1136 sayılı Kanunun adli yardım hükümlerine göre avukatlık hizmeti sağlanır.

(3) Başvuru sahibi ve uluslararası koruma statüsü sahibi kişi, sivil toplum kuruluşları tarafından sağlanan danışmanlık hizmetlerinden faydalanabilir.
