Article 423: b. Reduction

Part Two: Special Obligational Relationships › Chapter Six: Contracts of Service › Division One: General Contract of Service

If the employee, through his or her own fault, fails to perform the service for a total period exceeding one month within a year of service, the employer may reduce the paid annual leave by one day for each full month not worked.

If the employee, within a year of service, is unable to perform the work for a period of up to three months without fault on his or her part due to reasons inherent in his or her person, such as illness, accident, or the performance of a legal obligation or public duty, the employer may not make any reduction in the paid annual leave.

The employer may not make any reduction in the paid annual leave of a female employee who is unable to perform the work for a period of up to three months due to pregnancy and childbirth.

No provision contrary to the provisions of the second and third paragraphs may be made by service contracts or collective labour agreements in a manner producing effects to the detriment of the employee.

MADDE 423 · b. İndirimi

İşçi, bir hizmet yılı içinde kendi kusuruyla toplam bir aydan daha uzun bir süreyle hizmeti yerine getirmediği takdirde işveren, çalışılmayan her tam ay için, yıllık ücretli izin süresinden bir gün indirim yapabilir.

İşçi, bir hizmet yılı içinde kendi kusuru olmaksızın hastalık, kaza, yasal bir yükümlülüğün veya kamu görevinin yerine getirilmesi gibi kişiliğine bağlı sebeplerle en çok üç ay süreyle işgörme edimini yerine getiremediği takdirde, işveren yıllık ücretli izin süresinden indirim yapamaz.

İşveren, gebelik ve doğum yapma sebebiyle işgörme edimini en çok üç ay süreyle yerine getiremeyen kadın işçinin yıllık ücretli izin süresinden indirim yapamaz.

Hizmet veya toplu iş sözleşmeleriyle, işçinin aleyhine hüküm doğuracak şekilde, ikinci ve üçüncü fıkra hükümlerine aykırı düzenleme yapılamaz.
