Amended first paragraph: 13/4/1983, Law No. 2814, Art. 3 Where one of the independent units of an immovable property on which condominium ownership has been established, or a land share to which a construction servitude is attached, is sold, the other condominium owners or holders of servitude rights shall have no right of pre-emption.
Where one of the co-owners of an independent unit sells his or her own share to another person, the other co-owners may exercise the right of pre-emption.
The contract may contain a provision contrary to this Article.

(Değişik birinci fıkra: 13/4/1983 - 2814/3 md.) Kat mülkiyeti kurulmuş bir gayrimenkulün bağımsız bölümlerinden birinin veya kat irtifakı bağlanmış arsa payının satılması halinde diğer kat maliklerinin veya irtifak hakkı sahiplerinin öncelikle satın alma hakkı yoktur.
Bir bağımsız bölümün paydaşlarından birinin kendi payını başkasına satması halinde öteki paydaşlar, öncelikle satınalma hakkını kullanabilirler.
Sözleşmede bu maddenin aksine hüküm konulabilir.
