Where condominium ownership is transferred to another person or passes by way of inheritance, the land share attached to it shall pass together with it; the land share may neither be transferred separately from the condominium ownership or the construction servitude, nor pass by way of inheritance, nor be encumbered with any other right.
No land share may be left in the main property that is not attached to condominium ownership or in favour of which no construction servitude has been established.
Rights encumbering condominium ownership shall automatically encumber the land share as well.
No servitudes incompatible with the construction servitude may be established over the land plot subject to such right.
Rights registered or annotated on the page of the main property in the register before the establishment of condominium ownership on that property shall automatically encumber the condominium ownership as well, as a rule in proportion to the land share.

Kat mülkiyetinin başkasına devri veya miras yoluyla geçmesi halinde, ona bağlı arsa payı da birlikte geçer; arsa payı, kat mülkiyetinden veya kat irtifakından ayrı olarak devredilemiyeceği gibi, miras yoluyla da geçmez ve başka bir hakla kayıtlanamaz.
Anagayrimenkulde, kat mülkiyetine bağlanmamış veya lehine kat irtifakı kurulmamış arsa payı bırakılamaz.
Kat mülkiyetini kayıtlayan haklar, kendiliğinden arsa payını da kayıtlar.
Kat irtifakına konu olan arsa üzerinde bu hakla bağdaşması mümkün olmayan irtifaklar kurulamaz.
Anagayrimenkulde kat mülkiyetinin kurulmasından önce o gayrimenkulün kütükteki sayfasına tescil veya şerhedilmiş olan haklar kat mülkiyetini de, kaide olarak arsa payı oranında, kendiliğinden kayıtlar.
