Holders of construction servitude shall have the right to mutually demand and bring an action for the performance of the obligations incumbent upon them for the building to be constructed on the common land plot to be started and completed within the period stated in the contract.
Amended: 13/4/1983, Law No. 2814, Art. 7 Holders of construction servitude may appoint one or more persons from among themselves or from outside as manager for the completion of the building. The provisions concerning the duties, powers and responsibilities of the condominium manager shall also apply to this manager.
Added: 13/4/1983, Law No. 2814, Art. 7 In immovable properties on which a construction servitude has been established, if the building has actually been completed and two thirds of the independent units have actually begun to be used, the provisions on condominium ownership shall apply to the management of the main property even if the transition to condominium ownership has not taken place.

Kat irtifakı sahipleri, ortak arsa üzerinde yapılacak yapının, sözleşmede yazılı süre içinde başlaması ve tamamlanması için kendilerine düşen borçların yerine getirilmesini, karşılıklı olarak isteme ve dava etme hakkına sahiptirler.
(Değişik: 13/4/1983 -2814/7 md.) Kat irtifakı sahipleri yapının tamamlanması için kendi aralarından veya dışarıdan bir veya birkaç kişiyi yönetici olarak tayin edebilirler. Kat mülkiyeti yöneticisinin görev, yetki ve sorumluluklarına dair hükümler, bu yönetici hakkında da uygulanır.
(Ek: 13/4/1983 - 2814/7 md.) Kat irtifakı kurulmuş gayrimenkullerde yapı fiilen tamamlanmış ve bağımsız bölümlerin üçte ikisi fiilen kullanılmaya başlanmışsa, kat mülkiyetine geçilmemiş olsa dahi anagayrimenkulün yönetiminde kat mülkiyeti hükümleri uygulanır.
