Where it is necessary to enter another independent unit for the repair or remedying of damage or a defect occurring in the independent unit of one of the condominium owners or in the facilities of that unit, or for the reconstruction of the facilities, or for technical inspections deemed necessary in relation to building safety, the owner of that unit or those residing in that unit in another capacity shall be obliged to grant permission to enter and to tolerate the performance of the necessary works in the unit.
In the event of the partial destruction of the main immovable property, where it is necessary to make use of the inside or outside of the independent units that have remained intact for the reconstruction of the destroyed independent units and their annexes or of the common areas or of the facilities in the independent unit, the owners of those units or those residing there in another capacity shall be obliged to permit this.
The owners of the independent units in whose favour permission has been granted shall be obliged to compensate immediately the damage that the condominium owners or those residing there in another capacity suffer because of the permission referred to in the paragraphs above.

Kat maliklerinden birinin bağımsız bölümünde veya bu bölümdeki tesislerde meydana gelen bir hasar veya bozukluğun onarımı veya giderilmesi veya tesislerin yeniden yapılması ile yapı güvenliğiyle ilgili olarak yapılması gerekli görülen teknik incelemeler için diğer bir bağımsız bölüme girmek gerekiyorsa, o bölümün maliki veya o bölümde başka sıfatla oturanlar, giriş müsaadesi vermeye ve bölümde gerekli işlerin yapılmasına katlanmaya mecburdurlar.
Anagayrimenkulün bir kısmının harap olması halinde, harap olan bağımsız bölüm ve eklentilerinin veya ortak yerlerin veya bağımsız bölümdeki tesislerin yeniden yapılması için, sağlam kalan bağımsız bölümlerin içinden veya dışından faydalanılması gerekiyorsa, o bölümlerin malikleri veya orada başka sıfatla oturanlar buna müsaade etmeye mecburdurlar.
Yukarıdaki fıkralarda yazılı müsaade yüzünden, kat maliklerinin veya orada başka sıfatla oturanların uğrayacakları zararı, lehine müsaade verilen bağımsız bölüm malikleri derhal ödemekle yükümlüdürler.
