Article 10: Employment contracts in continuous and non-continuous work

Chapter Two: Employment Contract, Its Types and Termination

Work which, by its nature, lasts at most thirty working days is called non-continuous work, and work lasting longer than that is called continuous work.

Articles 3, 8, 12, 13, 14, 15, 17, 23, 24, 25, 26, 27, 28, 29, 30, 31, 34, 53, 54, 55, 56, 57, 58, 59, 75, 80 and provisional Article 6 of this Law shall not apply to employment contracts concluded for non-continuous work. In non-continuous work, the provisions of the Code of Obligations shall apply to the matters regulated in these articles.

MADDE 10 · Sürekli ve süreksiz işlerdeki iş sözleşmeleri

Nitelikleri bakımından en çok otuz iş günü süren işlere süreksiz iş, bundan fazla devam edenlere sürekli iş denir.

Bu Kanunun 3, 8, 12, 13, 14, 15, 17, 23, 24, 25, 26, 27, 28, 29, 30, 31, 34, 53, 54, 55, 56, 57, 58, 59, 75, 80 ve geçici 6 ncı maddeleri süreksiz işlerde yapılan iş sözleşmelerinde uygulanmaz. Süreksiz işlerde, bu maddelerde düzenlenen konularda Borçlar Kanunu hükümleri uygulanır.
