Article 13: Part-time and full-time employment contract

Chapter Two: Employment Contract, Its Types and Termination

Where the normal weekly working time of the employee is determined to be considerably less than that of a comparable employee working under a full-time employment contract, the contract is a part-time employment contract.

An employee employed under a part-time employment contract may not, solely because the employment contract is part-time, be treated differently from a comparable full-time employee, unless there is a reason justifying the differentiation. Wages and divisible monetary benefits of an employee working part-time shall be paid in proportion to the period worked, as compared with a comparable full-time employee.

A comparable employee is an employee employed full-time in the workplace in the same or similar work. Where there is no such employee in the workplace, an employee employed under a full-time employment contract who undertakes the same or similar work in a workplace in that branch of activity meeting the conditions shall be taken as the basis.

Where a vacancy suited to their qualifications exists, requests of employees working in the workplace to be transferred from part-time to full-time or from full-time to part-time work shall be taken into consideration by the employer, and vacancies shall be announced in due time.

Added paragraph: 29/1/2016, Law No. 6663, Art. 21 After the end of the leaves provided for in Article 74 of this Law, one of the parents may request to work part-time under this article until the beginning of the month following the date on which the child reaches compulsory primary education age. This request shall be met by the employer and shall not constitute a valid reason for termination. An employee who has started working part-time within the scope of this paragraph may return to full-time work, on condition that he or she does not benefit from this right again for the same child. Where an employee who has switched to part-time work starts working full-time, the employment contract of the employee recruited in his or her place shall terminate automatically. An employee who wishes to benefit from this right or to return to full-time work shall notify the employer thereof in writing at least one month in advance. Where one of the parents does not work, the working spouse may not request to work part-time. Persons who adopt, jointly with their spouse or individually, a child who has not completed the age of three shall also benefit from this right as of the date on which the child is actually handed over.

Added paragraph: 29/1/2016, Law No. 6663, Art. 21 The sectors or types of work in which part-time work may be performed within the scope of the fifth paragraph, and the procedures and principles relating to implementation, shall be determined by a regulation to be issued by the Ministry of Labour and Social Security.

MADDE 13 · Kısmî süreli ve tam süreli iş sözleşmesi

İşçinin normal haftalık çalışma süresinin, tam süreli iş sözleşmesiyle çalışan emsal işçiye göre önemli ölçüde daha az belirlenmesi durumunda sözleşme kısmî süreli iş sözleşmesidir.

Kısmî süreli iş sözleşmesi ile çalıştırılan işçi, ayırımı haklı kılan bir neden olmadıkça, salt iş sözleşmesinin kısmî süreli olmasından dolayı tam süreli emsal işçiye göre farklı işleme tâbi tutulamaz. Kısmî süreli çalışan işçinin ücret ve paraya ilişkin bölünebilir menfaatleri, tam süreli emsal işçiye göre çalıştığı süreye orantılı olarak ödenir.

Emsal işçi, işyerinde aynı veya benzeri işte tam süreli çalıştırılan işçidir. İşyerinde böyle bir işçi bulunmadığı takdirde, o işkolunda şartlara uygun işyerinde aynı veya benzer işi üstlenen tam süreli iş sözleşmesiyle çalıştırılan işçi esas alınır.

İşyerinde çalışan işçilerin, niteliklerine uygun açık yer bulunduğunda kısmî süreliden tam süreliye veya tam süreliden kısmî süreliye geçirilme istekleri işverence dikkate alınır ve boş yerler zamanında duyurulur.

(Ek fıkra: 29/1/2016-6663/21 md.) Bu kanunun 74 üncü maddesinde öngörülen izinlerin bitiminden sonra mecburi ilköğretim çağının başladığı tarihi takip eden ay başına kadar bu maddeye göre ebeveynlerden biri kısmi süreli çalışma talebinde bulunabilir. Bu talep işveren tarafından karşılanır ve geçerli fesih nedeni sayılmaz. Bu fıkra kapsamında kısmi süreli çalışmaya başlayan işçi, aynı çocuk için bir daha bu haktan faydalanmamak üzere tam zamanlı çalışmaya dönebilir. Kısmi süreli çalışmaya geçen işçinin tam zamanlı çalışmaya başlaması durumunda yerine işe alınan işçinin iş sözleşmesi kendiliğinden sona erer. Bu haktan faydalanmak veya tam zamanlı çalışmaya geri dönmek isteyen işçi işverene bunu en az bir ay önce yazılı olarak bildirir. Ebeveynlerden birinin çalışmaması hâlinde, çalışan eş kısmi süreli çalışma talebinde bulunamaz. Üç yaşını doldurmamış bir çocuğu eşiyle birlikte veya münferiden evlat edinenler de çocuğun fiilen teslim edildiği tarihten itibaren bu haktan faydalanır.

(Ek fıkra: 29/1/2016-6663/21 md.) Beşinci fıkra kapsamında hangi sektör veya işlerde kısmi çalışma yapılabileceği ile uygulamaya ilişkin usul ve esaslar Çalışma ve Sosyal Güvenlik Bakanlığınca çıkarılacak yönetmelikle belirlenir.
